1. Introduction

Welcome to RTST.ai ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our AI-powered image and video generation platform, including our website, mobile applications, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 16 years old
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and complete

3. Account Registration and Security

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your account credentials
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.

4. Subscription Plans and Billing

4.1 Subscription Plans

We offer various subscription plans with different features and credit allocations:

• Weekly Plan: Billed weekly with specified credits
• Monthly Plan: Billed monthly with specified credits
• Quarterly Plan: Billed every 3 months with specified credits

4.2 Automatic Renewal

All subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method for the recurring subscription fee.

4.3 Payment Processing

All payments are processed securely through Stripe. We do not store your complete credit card information. You agree to provide current, complete, and accurate payment information.

4.4 Pricing Changes

We reserve the right to modify our pricing at any time. Price changes will not affect your current billing period but will apply to subsequent renewal periods. We will notify you of any price changes at least 30 days in advance.

4.5 Credits and Usage

• Credits are allocated per billing period and do not roll over to subsequent periods
• Unused credits expire at the end of each billing period
• Credits cannot be transferred, exchanged for cash, or refunded
• Additional credits may be purchased separately (if available)

5. Refund Policy

Refunds will only be issued in the following circumstances:

• Core AI generation features are completely non-functional
• Service is unavailable for extended periods due to technical issues on our end
• We are unable to deliver the advertised features after reasonable attempts to resolve the issue

Refunds will NOT be issued for:

• Change of mind or buyer's remorse
• Unused credits or subscription time
• Dissatisfaction with generated content quality (subjective results)
• Failure to cancel before automatic renewal
• Account suspension or termination due to violation of these Terms

If you believe you qualify for a refund under the conditions stated above, please contact us at support@rtst.ai within 7 days of the issue occurring, with detailed information about the problem.

6. Cancellation and Termination

6.1 Canceling Your Subscription

You may cancel your subscription at any time through the Stripe Customer Portal or by contacting support@rtst.ai. Visit our How to Unsubscribe page for detailed instructions.

Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No further charges will be made after the current period ends
• Your account will automatically downgrade to the free tier (if available)
• Unused credits will be forfeited

6.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• You abuse or misuse the Service
• Your account poses a security risk
• Required by law or legal process

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including all content, features, functionality, software, designs, text, graphics, logos, and trademarks, is owned by DDT FZCO and protected by international copyright, trademark, and other intellectual property laws.

7.2 User-Generated Content

You retain ownership of any images, photos, or content you upload to the Service ("User Content"). By uploading User Content, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, process, and display your User Content solely to provide the Service
• The right to use your User Content to train and improve our AI models
• The right to create derivative works based on your User Content as necessary to provide the Service

7.3 AI-Generated Content

Images and videos generated by our AI ("Generated Content"):

• You own the Generated Content you create using the Service
• You may use Generated Content for personal and commercial purposes
• You are responsible for ensuring your use of Generated Content complies with applicable laws
• You may not use Generated Content in any way that violates the rights of others or applicable laws

8. Prohibited Uses

You agree NOT to use the Service to:

• Generate illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Generate content depicting minors in inappropriate contexts
• Create deepfakes or manipulated content intended to deceive or harm others
• Infringe upon the intellectual property rights of others
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service's operation
• Use automated systems (bots, scrapers) to access the Service without permission
• Resell or redistribute the Service without authorization
• Remove watermarks or attribution without a paid subscription

9. Content Moderation

We employ automated and manual content moderation to prevent misuse of the Service. We reserve the right to:

• Review, monitor, and remove User Content and Generated Content
• Refuse to process requests that violate our content policies
• Suspend or terminate accounts that repeatedly violate content policies
• Report illegal content to appropriate authorities

10. Disclaimers and Limitation of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

10.2 No Guarantee of Results

We do not guarantee that:

• The Service will meet your specific requirements or expectations
• Generated Content will be of satisfactory quality or accuracy
• The Service will be uninterrupted, timely, secure, or error-free
• Any errors or defects will be corrected

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DDT FZCO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless DDT FZCO, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content or Generated Content
• Your violation of applicable laws or regulations

12. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our privacy practices as described in the Privacy Policy.

13. Third-Party Services

The Service may contain links to or integrate with third-party websites, services, or applications. We are not responsible for:

• The content, privacy practices, or terms of third-party services
• Your interactions with third-party services
• Any damages or losses resulting from your use of third-party services

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Sending an email notification to your registered email address
• Displaying a prominent notice in the Service

Your continued use of the Service after changes become effective constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and cancel your subscription.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the emirate of Dubai, without regard to conflict of law principles.

15.2 Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the Service:

• You agree to first contact us at support@rtst.ai to attempt to resolve the dispute informally
• If the dispute cannot be resolved informally within 30 days, either party may initiate formal dispute resolution
• Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DDT FZCO regarding the Service and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
